Criminal Court ‘A’ Judge Willie Fines Officials…

MONROVIA, LIBERIA-Criminal Court ‘A’ Judge Roosevelt Willie has fined several officials five hundred US Dollars each for defying the Court, and their failure to produce the defendant in the case involving the Guinea National, Ibrahima Kalil Cherif.

Those fined are Solicitor General Cllr. Augustine Fayiah, County Attorney Cllr. Richard Scott, Assistant Justice Minister for Litigations Cllr. Garlawolo, and Monrovia Central Prison Superintendent Adolphus Lake, and are given seventy-two hours to pay between November 22 to 25.

The decision of the Court was as a result of the Writ of Habeas Corpus filed by the Independent Commission on Human Rights (INCHR) before the Court for Prosecution to produce the living body of the Guinean National who was detained at the Monrovia Central Prison.

But during arguments, Prosecution told the Court that they have since turned the living body over to the Guinean Government based on the excellence of the its bilateral cooperation with Liberia contained in a Note Verbal, copy of which is in the possession of ELBC.

The document also verified that Ibrahima is a Guinean and lives in the Sangoyah District of Conakry where, as part of international police cooperation and the fight against traditional crime, they were informed of his arrest in Liberia.

Having regard for the Criminal Police Cooperation signed in Accra, Ghana, on December 19, 2003, to which Liberia and Guinea are signatories, it was in this context on investigation that the Guinean Government requested the surrendering of Ibrahima Kalil Cherif to the police on the basis of Article 11 of the Agreement.

Ibrahima Kalil Cherif was charged with multiple offenses ranging from armed insurrection, criminal facilitation, criminal conspiracy, and criminal solicitation among others.

Meanwhile, Judge Roosevelt Willie has ordered that the Sheriff returned app properties of defendant Ibrahima to the Court’s custody to their counsels of records.
