State Prosecutors filed Motion of Recusal of 13th Judicial Circuit Court Judge in Kakata

MONROVIA, LIBERIA-State Prosecutors on Monday filed a motion for recusal of Judge Mardea Chenoweth of the 13th Judicial Circuit Court in Kakata, Margi County, in the case involving Suspect Oliver Dillon.

In the September 14, 2020 motion, the State Prosecutors strongly noted that Judge Chenoweth’s charge over the case is questionable, within the context of dispensing fair trial.

Judge Chenoweth, in March 2019, granted a motion to bail Defense Counsel on grounds that prosecution was ill-prepared, whenever the case was called for hearing.

In counter, State Prosecutors argued that the motion was earlier denied by then Justice in Chambers, Joseph Nagbe, on grounds that the crime murder was a capital offense, but was ignored by the Judge Chenoweth, thus granting Suspect Dillon motion to bail.

On September 4, 2020, the Supreme Court ruled on the Bill of Information, stressing that the continuous absence of prosecution, when the case was called for hearing, was an infringement of the Defendant’s right.

The Supreme Court, in its opinions, mandated the appearance of Suspect Oliver Dillon twice weekly, Tuesdays and Thursdays, to sign and risked being rearrested and sent to common jail for non-compliance.

In another development, the Monrovia City Court has sent to jail a forty-year-old-man for alleged circumstantial murder.

According to police investigation, suspect Augustine Kanneh was charged with the offense into the death of Armah Kiadii, whose unconscious body was discovered by him at his post of assignment, within the fence of Lone Star Cell in Bomi County.

The incident occurred on August 2,2020 this year.

The deceased was a private security guard and an employee of Lone Star station in Grand Cape Mount County, and responsible for monitoring the supply of fuel oil delivery to the various Lone Star towers in Bomi, Grand Cape Mount and Gbarpolu Counties.

The suspect is also a private security guard of the Protect Co Agency assigned at Lone Star point of sales.
