MONROVIA, LIBERIA-The Assistant Clerk of the National Labor Court is facing an internal investigation for reportedly failing to subscribe an appeal record for a defendant who lost a matter before the court.
It followed a petition to the Supreme Court of Liberia by lawyers representing the Insurance Company to dismiss an appeal filed by the respondent, Efua Reynolds Doe of Monrovia.
During Wednesday’s legal argument, lawyers representing the insurance company told the court that respondents failed to perfect their appeal during the statutory period, thus praying the court to dismiss the matter.
But the respondents’ lawyer, Cllr. Johnny Momoh rejected their claims, saying that they have since paid forty thousand Liberian Dollars to the Assistant Court Clerk, Wellington Keah, to subscribe to records for the appeal process.
Cllr. Momoh’s account was backed by several documentary evidence, including receipts that he paid the amount to the clerk in question.
The respondents’ lawyer’s claims to the court compelled Chief Justice Yamie Gbeisay to order an investigation before the matter was adjourned.
According to the ELBC Judicial Reporter, the Assistant Labor Court Clerk risks being suspended or dismissed if the respondent lawyer’s claim is established to be true.
Meanwhile, the Supreme Court has begun hearing several cases on motion to dismiss.
During the commencement of several court hearings on Wednesday, Chief Justice Gbeisay urged the Imam of the Supreme Court to begin wearing a dark suit before offering prayers at the court or risk being fined.
Chief Justice Gbeisay said,” No other attire can be worn before the Supreme Court, except dark suits”.
The Chief Justice had, on several occasions, warned lawyers about the official dress code as provided by the rules of court, stating that wearing any color suit other than the prescribed one is unacceptable.
