MONROVIA, LIBERIA-Associate Justice of the Supreme Court of Liberia Yusif Kaba has declined to issue the Alternative Writ prayed for by the former Finance minister, Samuel Tweah, and four others through their Legal Team.
Justice Kaba’s action is as a result of a conference with Defense Lawyers on the petition earlier filed.
The non-issuance of the Alternative Writ by Justice Kaba means that the stay order placed on the matter will be lifted in a couple of days for the five former Government officials in the criminal case at Criminal Court “C”.
Recently, suspect Samuel Tweah, Moses Cooper, Cllr. Nyenati Tuan and Jefferson Karmoh petitioned for a Writ of Prohibition to prohibit the Liberia Anti-Corruption Commission and the Ministry of Justice from proceeding with their case at the Court.
The Lawyer of the five former Government officials, Cllr. Arthur Johnson’s petition to the Court claimed that the six-point-five million US Dollars that led to their arrest were bordering on national security.
Cllr. Johnson maintained that the amount in question was expended by the National Security Community to protect the country from security threats during the 2023 National Elections.
At the same time, Associate Justice Kaba has issued an Alternative Writ of Mandamus on the National Elections Commission (NEC) Chairperson, Davidetta Brown Lansanah, for allegedly refusing to recognize the National Patriotic Party (NPP) Leadership headed by Atty. George Mulbah.
A Writ of Mandamus is a special proceeding to obtain a writ requiring the Respondent to perform an official duty consistent with the law.
The Justice in Chambers’ writ resulted from a petition filed by Atty. Mulbah, following a legal conference with lawyers from the two parties.
The writ also mandated Madam Brown Lansanah to file her returns on or before September 6, to set the stage for litigation between the parties.
The NPP embattled Chairman’s lawyer, Cllr. Bob Laywheel’s petition to the Court among other things, alleged that the National Elections Commission has not interacted with his client after he withdrew the Party from the Coalition.
